Post: Auditory Implant Failure

If an auditory implant fails, can the consumer recover the cost of the surgery in addition to the replacement of the defective device in the event the manufacturer attempted to exclude consequentail damages from its express warranty. Likely, the patient didn't see the warranty materials until after the surgery. Thanks.
