On December 17th of 2008 I was rear ended in Oceanside NY
by a State Farm Insured (Fillipo Califano). I called 911 as
soon as I was hit and within less than 5 minutes a police
officer was on the scene. The police officer took both of
our statements in which myself and the person that hit me
stated that he hit me from behind. The person that hit me
was found to be 100% at fault by State Farm and the repairs
for my car were also approved by State Farm.
My car was repaired, however I never received the check
from State Farm. I found out that after the car was
approved and repaired that State Farm took back the
approval. Stating that the police took to long to arrive at
the scene (the police dispatch log states the officer was
there in less than 5 minutes from the time I called 911)
and that 3 weeks after the accident 2 people came forward
stating I backed into the person that hit me in a parking
lot a block away (even though the person that hit me
admitted to the police officer in the report that he hit
me.
I also came to find out that the person that hit me claimed
the damages to his car from him hitting me onto an existing
claim from an accident he was involved in, in November of
2008. On top of all this I also found out that the person
that hit me was arrested and convicted of 1st degree
robbery and violent offenses in August 2007.
It frustrates me and boggles my mind that State Farm
ignored the lawful and truthful facts regarding the
accident and denied the claim after the car was repaired
based on hear say from made up witnesses. Now I have to pay
for the repairs out of pocket on top of a back injury
stemming from the accident.
I do not understand where the justice is regarding this
situation, I would like to make others aware of the wrong
doing by State Farm by telling my story.
