Robin: You seem to be describing a combination of maintenance and possible building defect issues. Someone with a structural engineering certification needs to determine which you are dealing with. If your problems are a result of poor building maintenance that is allowing water to enter your building, then you have little to no recourse against the builder. This becomes a special assessment/ HOA issue and will cost everyone to correct the problem. As I stated awhile back, determining building defect versus maintenance issue is your first step to a solution. Either way, you will not find broad support among property owners. The corrective action is going to cause disruption, the stigma of building problems and will affect all property owners. You have already invested over a year on this, seems you need to find some expert advice. Stirring the pot has little value at this time.
